“Led by partners José Del Chiaro and Ademir Antonio Pereira Jr, ADVOCACIA JOSÉ DEL CHIARO’s antitrust practice is made up of two additional partners, two counsel and eight associates. Former partner Luís Nagalli left the rm in June 2021 to head the competition team at Madrona Advogados, but Luiz Felipe Ramos was promoted to the partnership in April 2021.

Pereira led the team that advised Google on its acquisition of Fitbit. Although the transaction did not meet Brazil’s notication thresholds, consumer protection group IDEC led a complaint against the tie-up in July 2020, asking CADE to review the deal. The authority had yet to decide whether it will close its inquiry into the merger or order the companies to notify the transaction at the time of writing. The rm is also acting for Algar Telecom and Associação Neo in opposing the acquisition of Oi’s mobile business by mobile operators Claro, TIM Participações and Telefonica Brazil. On the behavioural side, the rm is advising California-based cloud computing innovator Nutanix as a complainant in an abuse of dominance investigation by CADE into Red Hat. The enforcer is investigating whether Red Hat’s refusal to certify Nutanix’s software as compatible with its own products has harmed competition in the cloud computing space. The competition team is also defending Gilead Sciences in the authority’s investigation into its pricing practices. The probe follows dozens of complaints – including by multiple consumer protection associations – that accuse Gilead of using its patent rights for hepatitis C drugs to exclude competition and x prices.”
